Effective
January 1, 2024
OAC 5160-44-32 “Direct
Care Worker Rule”
allows:
• Parents of minor
children and spouses to serve
as a direct care worker to
provide waiver personal care
and nursing services.
• Other relatives
designated or appointed legal
authority to serve as a
direct care worker of waiver
services.
Your
loved one can receive Home
and Community-Based Services
HCBS are services available
to individuals to help
maintain their health and
safety in a community setting
in lieu of institutional care
ELIGIBILITY
To be eligible to provide
these services, your
“Minor Child” or
Spouse must be enrolled in:
MyCare
MyCare Ohio is a managed care
program designed for Ohioans
who receive BOTH Medicaid and
Medicare benefits.
OR
PASSPORT
PASSPORT Waiver is for
individuals age 60 or more.
If you meet the above
requirements, you are able to
provide services AND GET PAID
if you are a -
• Parent of an adoptive,
biological or step-parent of
an individual
• Spouse
• Relative
Children, grandparents,
grandchildren,
great-grandparents, great
grand-children, brothers,
sisters, aunts, uncles,
nephews, nieces, and
step-relations and parents of
an individual above the age
of seventeen
